YOUR RECOVERY. OUR FOCUS.

How we look into
a Fort Worth store injury.

Rainwater tracked past the entry mats on a stormy Saturday. A pallet jack parked at the end of an aisle. A stack of dog food bags that leans a little more each time someone pulls one off. Fort Worth store cases start with details like these, and with the video the store keeps.

Jot down the store, the street, the date, and the time on your receipt. Then call. We ask the store in writing to hold on to its camera footage, sweep logs, and incident report. Hurt at a Walmart or a Kroger? Read about Walmart injuries in Fort Worth or our Kroger fall guide.

Let’s talk about your situation ↗
01 / EXPERIENCE

Trial-focused representation.

Check Aaron Herbert’s State Bar profile before you call. Then ask how we would build your case if the store’s insurer says no and it goes before a Tarrant County jury.

02 / EVIDENCE

The video comes first.

Store cameras record over old footage. Our first letter asks the store to save the views of your aisle, the front doors, and the cleanup after you fell.

03 / YOU

You get a real person.

Bring your questions about doctors, lost pay, and calls from the store’s claims company. You will know who your contact is and how often you will hear from us.

FORT WORTH AND TARRANT COUNTY

What a Fort Worth
store case looks
like up close.

Stores in Fort Worth rang up about $16.1 billion in retail sales in 2022, per the Census Bureau (as viewed November 1, 2026). The city counted 918,915 residents in the 2020 Census, and most of them buy groceries every week.

01

Where would my case be heard?

A suit against a store in Tarrant County usually starts in the civil district courts at the Tom Vandergriff Civil Courts Building, 100 N. Calhoun Street. A national chain may try to move it to the federal courthouse in Fort Worth. That can happen when the store and the shopper are from different states and more than $75,000 is at stake.

Federal statute ↗

02

Is a rainy-day puddle the store’s fault?

Not on its own. Here is a real one. A shopper slipped in the toy aisle of an H-E-B after a storm. She saw water dripping from a rafter. The store’s video showed no employee had come down that aisle for two hours. On April 10, 2026, the Texas Supreme Court ruled for the store anyway. Nothing showed how long the water had been sitting there.

H-E-B v. Peterson ↗

03

Can the store just erase the video?

Not once it should see a claim coming. In Brookshire Brothers v. Aldridge (2014), a customer slipped on grease near the rotisserie chickens. The store copied about eight minutes of video. The system taped over the rest, as it did every 30 days or so. The Texas Supreme Court said the judge decides whether the store should have kept more. A jury hears about lost video only if the store hid it on purpose, or if its carelessness left the shopper with no way to prove the claim.

Opinion ↗

04

What if I tripped on the city sidewalk outside?

A cracked city sidewalk may mean a claim against the City of Fort Worth, and those move fast. State law gives you six months to send written notice (§101.101). The city’s claim form says 180 days, citing its charter. You also have to prove the city knew that slab was broken.

WHY CHOOSE AARON HERBERT?

Choosing counsel
after a store injury.

Use the first call to test us. Ask what records we would want from the store, who would handle your file, and how fees work before you sign anything.

From the firm: why speaking with an injury attorney matters.

A board-certified trial lawyer

You can look up Aaron’s certification on the State Bar of Texas website in about a minute. We encourage it.

Help finding a doctor

No health insurance? Can’t get an MRI scheduled? Tell us. We can help you find providers in Fort Worth and talk through how treatment might get paid.

We dig into the store’s file

A store may have written up the same leaky cooler twice that month. We ask for incident reports, sweep logs, work orders, and the names of the workers on that shift.

We take the adjuster’s calls

Once you hire us, the claims company calls us, not you. Bring every letter and email you have gotten so far. We will read them first.

Ready for trial if it comes to that

Most cases settle. Insurers watch which lawyers are willing to try a case. We prepare every file as if a jury will see it.

No fees or expenses unless you recover

The first meeting is free. Ask us to walk you through the fee and the costs, with a sample number, before you sign. The contract spells it out.

AFTER A STORE INJURY

What to bring to
your free consultation.

Bring the store address, the date, your photos, the incident report number, and any letters from a claims company. Keep the receipt. It shows when you checked out. You do not need all of it to call.

  1. 1

    Tell a manager.

Ask for an incident report before you leave and get the report number. Say what happened and stop there. Don’t guess about your injuries.

  2. 2

    Take pictures.

Photograph the floor, the pallet, the shelf, or the box that fell, before anyone cleans up. Get a phone number from anyone who saw it.

  3. 3

    Get checked out.

Urgent care, the ER at JPS, your family doctor. Tell them exactly where and how it happened. Save the paperwork.

  4. 4

    Call before you sign.

Don’t give a recorded statement or cash a check from the store’s insurer until a lawyer has looked at it.

The puddle dries. The shelf gets restocked.

By the next morning the scene looks normal. Call soon so we can ask the store to keep the video and the records from that day.

UNDERSTANDING YOUR CLAIM

An injury is the beginning
of the story.
The evidence matters.

Getting hurt in a Fort Worth store does not by itself make the store pay. These are the three questions we ask first.

01

What did the store know?

As a shopper, you are what Texas law calls an invitee. The test comes from Keetch v. Kroger (1992). Did the store know about the danger, or should it have? Did it fail to fix it or warn you? Did that cause your injury?

02

How long was it there?

Picture a stocker ten feet from the spill when you go down. A 2002 case, Wal-Mart v. Reece, says that is not enough on its own. We look for footprints, cart tracks, a gap in the sweep log, or video of the spill hitting the floor.

03

How has your life changed?

Your medical records, pay stubs, and the things you can no longer do at home or at work.

Read how Texas injury claims are valued, see our Texas store injury page, or visit our Dallas store injury page if you were hurt in Dallas County. Chain guides: Target, Ross, Costco, Home Depot, Tom Thumb and Albertsons, Burlington, 7-Eleven, La Michoacana Meat Market, H-E-B, and Brookshire's.

CLEAR ANSWERS. A BETTER NEXT STEP.

Fort Worth store injury
questions.

Your situation is unique.
We’re here to listen.

Ask about your case ↗
Does it cost anything to talk with your firm?

No. The first talk is free. If you hire us, you pay no fee or expenses unless you recover. Ask us how the money would split on a sample settlement.

How is this page different from your other Fort Worth pages?

This page is about stores: grocery aisles, big-box shelves, checkout lines, and store lots. Our Fort Worth slip and fall page covers falls anywhere, and our Fort Worth premises liability page covers apartments, pools, and security cases. The first call is free either way.

I slipped near the deli counter. Do I have a case?

Maybe. Grease, ice, and dropped food pile up near deli and hot-food counters. The question is whether the store knew, or whether the mess sat long enough that someone should have found it. Video of the counter area can answer that.

What if I tripped over a pallet or a stocking cart?

Tell us. Stores restock during open hours, and a pallet left in the aisle was put there by the store, not a customer. That can help show the store knew. Photograph it before it moves.

Can the store say I should have seen it?

It will try. Under Texas law, a jury splits the blame. Over 50% on you means no recovery. At 20% on you, a $100,000 verdict becomes $80,000. A cone you couldn’t see from where you stood is worth a photo.

How long do I have to file a lawsuit?

Usually two years from the day you were hurt. If the city owns the sidewalk where you fell, written notice is due much sooner, often within six months. Calls with an adjuster do not pause any of this. The rule is in Texas Civil Practice & Remedies Code §16.003.

How much could my case be worth?

Nobody can honestly quote a number on the first call. A torn meniscus and a bruised elbow are very different cases. So are a store with clear video and one with none. We give you a range once we see the records.
