YOUR RECOVERY. OUR FOCUS.
How we investigate
your Walmart claim.
You went in for groceries. You left with a sprained wrist, or worse. Maybe it was water by the produce misters, or a pallet jack parked in the aisle. Now the bills are coming and an adjuster wants a recorded statement.
Tell us which store, what time, and what was on the floor. We will line that up with your photos, the incident report, and any video. Then you get a straight answer about what we see.
Let’s talk about your situationTrial-focused representation.
Check Aaron Herbert’s State Bar profile before you call. Then ask us how we would build your case if the store refuses to pay and it goes before a Tarrant County jury.
We chase the tape.
Store cameras record over old footage. Our first letter to Walmart asks it to save the video from your aisle, plus the ten minutes before you fell.
You get a real person.
Bring your questions about doctors, lost pay, and calls from the claims team. You will know who your contact is and how often you will hear from us.

What a Fort Worth
Walmart claim
looks like up close.
Fort Worth counted 918,915 residents in the 2020 Census, and its Walmart stores stay busy all week.
Where would my case be filed?
Tarrant County’s civil district courts sit in the Tom Vandergriff Civil Courts Building at 100 N. Calhoun Street. Walmart often asks to move cases to federal court when the parties live in different states and more than $75,000 is at stake. In Tarrant County, that means the Fort Worth Division of the Northern District of Texas.
What does Texas law ask about the spill?
A worker standing ten feet from the spill is not enough. That was the lesson of Wal-Mart Stores, Inc. v. Reece, a 2002 Texas Supreme Court case. You must show Walmart caused the mess, knew about it, or left it there long enough that someone should have caught it. Time-stamped video helps answer the “how long” question.
What if Walmart says I was careless?
Texas compares fault. If a jury puts more than 50% on you, you recover nothing. At 20%, your damages drop by 20%. That is why your shoes, your phone, and the lighting all come up in these cases.
How serious can a store fall be?
The CDC counts about 4.5 million emergency room visits a year for falls by older adults. About 37% of people who fall report an injury that needs care or limits activity for at least a day. For people over 65, a fall is the top cause of head injuries.
WHY CHOOSE AARON HERBERT?
Choosing counsel
for a Walmart injury.
Use the first call to test us. Ask what evidence we would want, who would handle your file, and how fees work before you sign anything.
From the firm: why speaking with an injury attorney matters.
A board-certified trial lawyer
You can look up Aaron’s certification on the State Bar of Texas website in about a minute. We encourage it.
Help finding a doctor
No health insurance? Can’t get an MRI scheduled? Tell us. We can help you find providers in Fort Worth and talk through how treatment might get paid.
We dig into the evidence
A video clip may show you falling. It may not show the twenty minutes before. We pull the clip, the report, your photos, and the names of people who saw it.
We take the adjuster’s calls
Once you hire us, the claims team calls us, not you. Bring every letter and email you have gotten so far. We will read them first.
Ready for trial if it comes to that
Most cases settle. Insurers watch which lawyers are willing to try a case. We prepare every file as if a jury will see it.
No fees or expenses unless you recover
The first meeting is free. Ask us to walk you through the fee and the costs, with a sample number, before you sign. The contract spells it out.
AFTER A WALMART FALL
What to bring to
your free consultation.
Bring the store address, the date, your photos, the report number, and any letters from the claims team. You do not need everything. Call even if all you have is a receipt and a sore knee.
- 1
See a doctor.
Go today if you can. Tell them you fell at Walmart. Keep every bill and discharge sheet.
- 2
Tell a manager.
Ask for the report number. Write down the manager’s name and the time.
- 3
Take pictures.
Snap the floor, your shoes, and the aisle sign. Get a phone number from anyone who saw you go down. Keep your receipt.
- 4
Call before you sign.
Don’t give a recorded statement or cash a check until a lawyer has looked at it.
A wet floor dries in minutes, and stores do not keep most video forever. Call soon so we can ask the store to save it.
UNDERSTANDING YOUR CLAIM
A fall is the beginning
of the story.
The evidence matters.
A fall alone does not make Walmart pay. These are the three questions we ask first.
What caused the fall?
Detergent from a broken jug. A freezer case dripping onto the tile. A curled mat by the doors. Rainwater tracked in past the carts.
What did the store know?
Did an employee see it? Did a customer report it? How long had it been there before you walked by?
Fell at a different store? Read our guides to falls at Target, Kroger, Tom Thumb and Albertsons, Home Depot, and Ross.
How has your life changed?
Your medical records, pay stubs, and the things you can no longer do at home or at work.
Read our Texas Walmart injury claims guide, see how injury claims are valued, visit our Fort Worth slip and fall page, or see our Fort Worth premises liability page. Hurt at a Dallas County store? See our Dallas Walmart injury page.
CLEAR ANSWERS. A BETTER NEXT STEP.
Walmart injury
questions.
Your situation is unique.
We’re here to listen.
Does it cost anything to talk with your firm?
No. The first talk is free. If you hire us, you pay no fee or expenses unless you recover. Ask us how the money would split on a sample settlement.
What if I did not take photos or file a report?
Call anyway. Lots of people are too hurt to grab their phone. The store may still have video, and its own report.
How long do I have to bring a Texas injury lawsuit?
Usually two years from the day you were hurt. A few exceptions can shorten or stretch that. An open insurance claim does not stop the clock, so ask us to check your date. See Texas Civil Practice & Remedies Code §16.003.
Can my case stay in Tarrant County court?
Sometimes. Walmart can ask to move a case to federal court in Fort Worth if the legal rules for diversity are met. Either way, the same Texas premises liability law applies to what you must prove.
What if the store says it never knew about the spill?
Stores say this in almost every case. So we ask for the sweep log, the video, and the shift schedule. Sometimes a customer told a cashier about the spill twenty minutes earlier.
Should I accept a settlement offer from the store?
Have the terms and the extent of your injuries reviewed before deciding. A settlement may release claims, and your future medical needs may not yet be clear.
How much could my case be worth?
Nobody can honestly quote a number on the first call. A broken hip and a bruised elbow are very different cases. So are a clear video and no video. We give you a range once we see the records.
What happens after I contact the firm?
Someone from our team calls you back. We ask what happened and how you are doing. If we can help, we explain the contract. If not, we tell you why.
