Because Experience, Expertise, and Results Matter.
When you're facing a life-altering injury, the law firm you choose is one of the most critical decisions you will make. Insurance companies have armies of lawyers protecting their profits. You need a team of advocates with the credentials and trial experience to level the playing field.
Board-Certified Expertise That Gives You an Edge:
Our founding partner, Aaron A. Herbert, is Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization. An Elite Level of Skill: Less than 2% of all attorneys in Texas have earned this distinction. It is a mark of true trial and legal expertise.
Proven Trial Experience: Board Certification requires a lawyer to have extensive first-chair trial experience, proving they are comfortable and effective in a courtroom. Choosing a law firm with a Board Certified attorney means you are working with a lawyer who has been independently vetted and recognized as a specialist in their field. It's the highest assurance of quality and commitment you can find in Texas.

DID YOU KNOW?
Understanding Your Rights After a Serious Injury in Texas
Navigating the legal system after an accident can be daunting, especially while dealing with physical and emotional trauma. Our team is here to guide you every step of the way. A serious injury impacts every aspect of your life. Our goal is to secure maximum compensation to cover all of your losses. In Texas, you generally have only two years from the date of the injury to file a personal injury lawsuit. It is crucial to act quickly to preserve your rights.
Basis of a Lawsuit.
Most personal injury claims are based on the legal theory of negligence.
Most personal injury lawsuits are built on the legal principle of negligence. To recover compensation, an injured person generally must show that another party owed them a duty of care, failed to act reasonably under the circumstances, and caused injuries as a result of that failure.
Negligence can take many forms, including distracted driving, unsafe property conditions, defective products, or other careless actions that place others at risk. Establishing negligence often requires evidence such as accident reports, witness statements, photographs, medical records, and expert testimony.
Because every case is unique, proving liability can be complex. An experienced personal injury attorney can investigate the facts, identify responsible parties, and build a strong claim designed to pursue the maximum compensation available under the law.
Deadline to file a claim.
In Texas, you have two years from the date of the accident to file a lawsuit.
In Texas, most personal injury lawsuits must be filed within two years of the date of the accident. This legal deadline, known as the statute of limitations, applies to many types of injury cases, including car accidents, truck accidents, motorcycle crashes, slip and falls, and other negligence-related claims.
Failing to file a lawsuit before the deadline expires can result in losing your right to seek compensation altogether. While certain exceptions may extend or shorten the filing period in limited circumstances, these situations are uncommon and depend on the specific facts of the case.
Because important evidence can disappear and witness memories may fade over time, it is generally in your best interest to speak with a personal injury attorney as soon as possible after an accident. Taking prompt action can help protect your rights and strengthen your claim.
Shared fault laws.
Texas is a modified comparative negligence state.
Texas follows a modified comparative negligence rule, which means more than one party can share responsibility for an accident. Under this system, an injured person may still recover compensation even if they were partially at fault for what happened.
However, the amount of compensation available is reduced by the injured person's percentage of fault. For example, if a person is awarded $100,000 in damages but is found to be 20% responsible for the accident, their recovery would be reduced to $80,000.
Texas also follows the 51% bar rule. If an injured person is found to be more than 50% at fault for the accident, they cannot recover compensation from the other party. Because fault determinations can have a significant impact on the value of a claim, it is important to work with an attorney who can effectively present evidence and protect your interests throughout the claims process.
Navigating the web of federal and state laws affecting your lawsuit doesn’t have to be a task you put upon yourself. Instead, entrust your claim to our personal injury team. We’ll use every tool in our repertoire to fight for the best possible outcome for your case. Whether you need assistance filing a personal injury, wrongful death, premises liability, product liability, or workers’ compensation claim, count on Aaron A. Herbert.
HOW WE TAKE CARE OF YOU!
Your Case. Your Recovery.
Our Responsibility.
What happens if the at-fault driver has no insurance or not enough coverage?
This is a serious and unfortunately common problem on Dallas County roads, but it does not necessarily mean you are out of options. Our experienced Dallas car accident lawyers will immediately investigate whether you have Uninsured/Underinsured Motorist (UM/UIM) coverage as part of your own auto insurance policy. This is valuable coverage that you pay for to protect yourself in exactly this situation. We can help you file a claim with your own insurer to cover the damages the at-fault driver could not.
Who is responsible for paying my medical bills while my case is pending?
Legally, you are responsible for your medical bills as you receive treatment. However, we understand that this can be an impossible burden for most people after a serious injury.
We can work with your medical providers on your behalf. In many cases, we can arrange for them to treat you under a “Letter of Protection,” which is a legal agreement that guarantees the provider will be paid directly from your future settlement. This allows you to get the critical medical care you need now without paying out of pocket.
Will my personal injury case have to go to trial in a Dallas court?
It is highly unlikely. The vast majority of personal injury cases—well over 95%—are resolved through a settlement before ever reaching a trial verdict. However, the ability and willingness to take a case to trial is a lawyer’s most powerful negotiating tool.
At The Law Firm of Aaron A. Herbert, P.C., our reputation and having a Board Certified trial lawyer at the helm mean we are always prepared for the courtroom, and we fight insurance companies to offer fair settlements during negotiations and mediation. They know we will not hesitate to go to court if they do not negotiate reasonably.
What is my role as the client after I hire your firm?
Your most important job is to focus on your medical treatment and recovery. We handle the legal fight. Your responsibilities as our client are straightforward: be completely honest with us about the facts of your case and your medical history, attend your scheduled doctor’s appointments, and keep us updated on your medical progress. By working together as a team, we can build the strongest possible case on your behalf.
