Got questions? Start here.
So what do you actually do?
We order the crash report. We send letters asking the city and the gas station on the corner to hold their video. We phone witnesses. Then we add up your bills and missed pay and check every policy. Your agreement says if we negotiate, sue, or both.
I was partly at fault. Is my case dead?
No, not unless you’re more than 50% to blame. Below that, Texas cuts your award by your share. 20% at fault on a $10,000 award? You’d get $8,000. See how shared fault changes a recovery.
How much time do I have?
Two years from accrual is the usual rule (§16.003). Exceptions exist. Some claims also need notice far sooner. We’ll check your date. Check the general date for your crash.
What does a consultation cost?
Nothing. The first meeting is free. Before you hire us, the written agreement spells out the contingency fee percentage and how case expenses work.
When should I seek help?
Call soon if you were badly hurt or the other side blames you. Call, too, if an adjuster wants a recorded statement or a store’s video could be erased.
Why trust Aaron A. Herbert as your Dallas car accident lawyer?
Choosing counsel means understanding who will investigate your crash, explain your options and prepare the case. The Law Firm of Aaron A. Herbert, P.C. represents seriously injured people in Dallas and brings trial preparation and personal injury experience to that work.
A Board Certified trial lawyer
Aaron A. Herbert is Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization. Ask what that credential and the attorney’s relevant experience mean for the work your case requires.
Board certification recognizes qualifications in a defined practice area. It does not promise a settlement amount or trial result.
Experience with insurance disputes
We evaluate disputed fault, medical causation and settlement positions against the evidence. Our work includes preparing records, examining insurer arguments and explaining the choices available to you.
Experience with serious injury claims
The firm’s published biography describes jury verdicts and settlements in serious injury cases and lists Million Dollar Advocates Forum membership.
Past outcomes do not guarantee or predict a result in your case.
What does that look like for you? A file with your MRI results, your doctor’s work notes, your pay stubs and a short list of things you can’t do anymore, like lifting your kid or driving to work. The facts, the law and the policy limits still decide what the claim is worth.
How bad is it out there? Dallas crash numbers for 2025
In 2025, TxDOT logged 24,677 crashes inside Dallas city limits. Every motor vehicle counts, from pickups to motorcycles to buses. The county gets its own row in the table below.
24,677
Total crashesDallas city · 2025

| Dallas County · all motor vehicles | 43,946 | 258 | 274 | 1,664 |
Neighbors notice the trouble spots too. In May 2025, the East Dallas Advocate wrote about residents’ worries over parts of Abrams and Skillman, using information from a city official. That’s one local story. It doesn’t rank the most dangerous roads in Dallas.
We talk with people hurt on roads like these:
- I-635 (LBJ Freeway)
- US-75 (Central Expressway)
- I-35E (Stemmons Freeway)
- The Dallas North Tollway
- I-30 and I-20
- Loop 12 (Northwest Highway)
A pile-up on Stemmons isn’t the same as a left-turn crash on Northwest Highway. Speed, sightlines and signals differ. So we look at your exact spot, not the road’s reputation.
Common causes of serious car wrecks in Dallas
What has to be proven? That the other driver did something wrong, and that it caused the crash and your injuries. Here’s what we look at for the causes we see most:
Speeding and aggressive driving
Was the driver doing 70 in a 45, or tailgating in the rain on I-30? We check speed, following distance, road conditions and lane changes. More speed means more crashes and worse injuries.
Distracted driving
A text. A call. A GPS screen. A breakfast taco. Phone records and witnesses can show what the driver was doing. Our guide covers evidence that may help prove driver distraction.
Alcohol impairment
Was the driver coming from a bar? We look at how they were driving. If the facts support it, we also ask whether the place that served them can be liable under Texas Dram Shop law. Alcoholic Beverage Code Chapter 2 sets its own rules for that claim. Serving a drink isn’t enough on its own.
Failure to yield right-of-way
A left turn across oncoming traffic. A red light run on Northwest Highway. A car rolling past a stop sign. Many bad intersection crashes start with one of these.
Fatigued driving
A driver who’s been up since 4 a.m. reacts slower and makes worse choices. We see it with truck drivers and night-shift workers heading home late.
Compensation we evaluate after a car accident
Our Dallas car accident attorneys evaluate both financial losses and the personal effects of your injuries. Depending on the evidence and applicable law, recoverable damages may include the following. No category or amount is automatic.
Economic damages
- Medical expenses: the ambulance ride, the ER visit, the hospital stay, surgery, follow-up visits and prescriptions. You have to prove them, and Texas applies Section 41.0105’s limitation to amounts actually paid or incurred.
- Future medical needs: what more physical therapy, rehab or a later surgery will likely cost.
- Lost wages: paychecks you missed while you couldn’t work.
- Loss of earning capacity: say you drove a forklift and now can’t lift 20 pounds. Your pay for the rest of your working life may drop. This item asks for that lost money.
- Property damage: what it costs to fix your car or replace it.
Non-economic damages
- Pain and suffering for the pain you’ve had since the crash and the pain still ahead.
- Mental anguish for fear, anxiety, depression, PTSD or nightmares about the wreck.
- Physical impairment when you can’t play ball, garden or do the things you used to do.
- Disfigurement for scars that stay with you.
What to do after a Dallas car accident
The days and weeks after a crash matter for your recovery and legal rights. The steps below address medical follow-up, preserving information and dealing with insurer requests.
Prioritize your medical recovery above all else
Follow every instruction from your medical team. Attend all follow-up appointments with specialists, physical therapists and your primary care physician, fill all prescriptions, and contact your doctor promptly about new or worsening pain.
Treatment records help document the timing, nature and progression of your injuries. Keep accurate records and discuss new or worsening symptoms with your medical provider; records must still be evaluated alongside the other evidence.
Gather and preserve all accident-related documentation
Create a physical or digital file and collect all evidence and information related to the accident: the police report number, the information you exchanged, photos and videos, medical paperwork and proof of lost income. If you have the report number, an attorney can obtain the full report for you. Use the checklist below.
Be cautious when speaking to insurance adjusters
An adjuster represents the insurer’s interests. Before giving detailed statements or signing a release, understand which insurer is asking, what your own policy requires and what rights the document may affect.
DoCall us before the other driver’s insurer records your statement. Have a lawyer read any release or medical form first. Find out what your future care will cost before you take an offer.Don’tAssume every insurer gets the same answer. Your own policy may require you to give notice and cooperate. And never sign a release you don’t understand. Once signed, it can end your claim even if your bills keep growing.Contact our experienced Dallas car collision lawyers
After you hire us, adjusters call us, not you, about the matters your agreement covers. We dig into who caused the crash, which policies apply and what you’ve lost. Got a question about a hospital bill, a missed paycheck or an adjuster’s letter? Bring it.
What might we collect?
- Video from a gas station or traffic camera
- What witnesses saw
- An inspection of the cars
- Crash data from a car’s computer, when there is any
Not every car stores data, and video gets erased. Moving early helps.

Your claim, step by step
- Initial reviewYou tell us what happened. It’s free, and you get our fees and expenses in writing.
- Preservation and investigationLetters go out to save video. We pull the crash report and talk to witnesses. Car data too, if any exists.
- Documenting lossesYour treatment, your bills, your missed work, and the care you’ll need later.
- Coverage and settlement discussionsWe find out which insurance can actually pay. Then we hold any offer up against your proven losses.
- Lawsuit, if appropriateDiscovery, expert witnesses, motions, mediation and maybe a trial.
The sequence and timing depend on the facts. Multi-vehicle and intersection cases may require comparing each impact, signal sequence, vehicle movement and witness account; the first report may not answer every question. If liability is denied, ask for the stated basis and discuss the evidence and available options rather than assume the claim has ended.
FAQs about Dallas car accident claims
What if the police report contains errors or lists me as being partially at fault?
A police report is not the final word on legal liability. It can contain factual errors or omit important details.
Our Dallas car crash lawyers can conduct a deeper investigation, looking for evidence such as surveillance video or eyewitness testimony that contradicts the report. We regularly handle cases where the initial findings of a police report are disputed.
The driver who caused my accident was a friend or family member. Do I have to sue them personally?
Insurance may provide a source of payment, but a negligence claim can involve the driver personally, and a lawsuit may name the driver. Policy limits, exclusions and the facts matter; coverage does not guarantee that a friend or relative has no personal exposure. We can explain the insurance and litigation options before you decide how to proceed. The Texas Department of Insurance’s auto guide explains liability coverage and the possibility of personal exposure beyond available limits.
How long does it take to resolve a car accident case in Dallas?
There is no single answer. The complexity of your injuries, the insurance company’s reasonableness and whether a lawsuit is needed can affect timing. A straightforward case might be resolved in a matter of months, while a catastrophic injury case that requires a lawsuit could take over a year.
A fast offer isn’t always a fair one. Hold it up against your bills, the care you’ll still need, the risk of trial and the policy limits. No lawyer can promise you a result.
Where would a Dallas car accident lawsuit be filed?
Most Dallas County injury suits go to the civil district courts in the George L. Allen Sr. Courts Building at 600 Commerce Street. Plenty of cases never reach a jury. We still build each file as if one will see it.
Does my own PIP cover me after a Dallas crash?
Probably. Every Texas auto policy has to include at least $2,500 of personal injury protection unless the policyholder rejected it in writing (Tex. Ins. Code §1952.152). Did you? If not, PIP can pay your medical bills and lost wages, even if the wreck was your fault.
