YOUR RECOVERY. OUR FOCUS.

How we investigate
your truck crash.

You were headed home on I-820 when a tractor-trailer drifted into your lane. Or a box truck pulled out of a warehouse lot without looking. Now your car is totaled, your neck hurts, and an adjuster for a carrier you’ve never heard of keeps calling.

Got a photo of the cab door? The USDOT number painted there pulls up the carrier’s federal safety record in seconds. No photo is fine too. The crash report usually lists it.

Let’s talk about your situation ↗
01 / EXPERIENCE

Trial-focused representation.

Check Aaron Herbert’s State Bar profile before you call. Then ask how we would build your case if the carrier won’t pay and it goes before a Tarrant County jury.

02 / EVIDENCE

We go after the truck’s data.

A big rig’s engine module and its electronic logging device record speed, braking and driving hours. Our first letter tells the carrier to save them, plus the dispatch notes and the driver’s file.

03 / YOU

You get a real person.

Bring your questions about doctors, lost pay, and calls from the claims team. You will know who your contact is and how often you will hear from us.

FORT WORTH AND TARRANT COUNTY

What a Fort Worth
truck claim looks
like up close.

TxDOT counted 2,183 crashes involving a commercial motor vehicle in Tarrant County in 2025, up from 1,716 the year before.

01

Why are there so many trucks here?

North Fort Worth is home to AllianceTexas, a 27,000-acre development built around Perot Field Fort Worth Alliance Airport and a BNSF intermodal yard. The Texas Comptroller reports that the BNSF yard handled more than 1.1 million container lifts in 2024. The site connects to I-35W, SH-170 and SH-114. Add I-820 and I-30, and a lot of your daily driving happens next to a loaded trailer.

Texas Comptroller: AllianceTexas ↗

02

How bad are these crashes in Tarrant County?

In 2025, TxDOT recorded 15 fatal crashes involving a commercial motor vehicle in Tarrant County. Sixteen people died, and 71 more had suspected serious injuries. Statewide that year, the count was 38,533 crashes and 528 deaths. A crash lands in this table when the officer checks the CMV box on the crash report, so buses and some work trucks are counted too.

TxDOT 2025 CMV crash data ↗

03

Where would my case be filed?

Tarrant County’s civil district courts sit in the Tom Vandergriff Civil Courts Building at 100 N. Calhoun Street. Plenty of trucking companies are based in other states. When the parties live in different states and more than $75,000 is at stake, the carrier often asks to move the case to federal court. In Tarrant County, that means the Fort Worth Division of the Northern District of Texas.

04

Can I sue the company that hired the trucker?

Sometimes. The broker who booked the load is one target. So is the shipper whose dock crew overloaded the trailer. In May 2026 the U.S. Supreme Court held in Montgomery v. Caribe Transport II that federal law does not wipe out a negligent-selection claim against a broker. Whether a broker actually chose a careless carrier is still a fight in every case.

WHY CHOOSE AARON HERBERT?

Choosing counsel
after a truck crash.

Use the first call to test us. Ask what records we would request, who would handle your file, and how fees work before you sign anything.

From the firm: why speaking with an injury attorney matters.

A board-certified trial lawyer

You can look up Aaron’s certification on the State Bar of Texas website in about a minute. We encourage it.

Help finding a doctor

No health insurance? Can’t get an MRI scheduled? Tell us. We can help you find providers in Fort Worth and talk through how treatment might get paid.

We read the federal rulebook

An interstate truck driver gets 11 hours behind the wheel after 10 hours off, all inside a 14-hour window (49 CFR §395.3). We hold the ELD log, fuel receipts and dispatch times up against those limits.

We take the adjuster’s calls

Once you hire us, the trucking company’s insurer calls us, not you. Bring every letter and email you have gotten so far. We will read them first.

Ready for trial if it comes to that

Most cases settle. Insurers watch which lawyers are willing to try a case. We prepare every file as if a jury will see it.

No fees or expenses unless you recover

The first meeting is free. Ask us to walk you through the fee and the costs, with a sample number, before you sign. The contract spells it out.

AFTER A TRUCK CRASH

What to bring to
your free consultation.

Bring the crash report number, your photos, the trucking company’s name, and any letters from an insurer. You do not need everything. Call even if all you have is a tow receipt and a sore back.

  1. 1

    See a doctor.

Go today if you can. Tell them a truck hit you. Keep every bill and discharge sheet.

  2. 2

    Get the report number.

The officer writes a Texas crash report, form CR-3. Ask for the report number and which agency took it.

  3. 3

    Photograph the truck.

Snap the cab door, where the company name and USDOT number are painted. Get the trailer number and the plate. Get a phone number from anyone who saw it happen.

  4. 4

    Call before you sign.

Don’t give the trucking company’s insurer a recorded statement or cash a check until a lawyer has looked at it.

Truck records don’t last forever.

Carriers only have to keep hours-of-service records for six months (49 CFR §395.8). Call soon so we can send a preservation letter while the ELD and engine data still exist.

UNDERSTANDING YOUR CLAIM

A truck crash is
the start of the story.
The records matter.

Getting hit by a truck does not make the carrier pay. These are the three questions we ask first.

01

What did the truck do?

Speed, braking and throttle in the seconds before impact. Many heavy trucks store that in an engine control module. Dashcam video and the crash report fill in the rest.

02

What did the company know?

Eleven hours is the federal driving limit for a big-rig driver. Worn brakes written up in March and still worn in June tell a story. Carriers must keep repair records for a year (49 CFR §396.3).

03

How has your life changed?

Your medical records, pay stubs, and the things you can no longer do at home or at work.

Read our truck accident evidence and litigation hub, see how Texas injury claims are valued, or visit our Fort Worth semi-truck accident page. Hurt east of here? See our Dallas truck accident page. Hurt at a store or on someone else’s property, not on the road? Start with our Fort Worth premises liability page, or our Fort Worth Walmart injury page if it happened at Walmart.

CLEAR ANSWERS. A BETTER NEXT STEP.

Truck accident
questions.

Your situation is unique.
We’re here to listen.

Ask about your case ↗
Does it cost anything to talk with your firm?

No. The first talk is free. If you hire us, you pay no fee or expenses unless you recover. Ask us how the money would split on a sample settlement.

How long do I have to file a truck accident lawsuit in Texas?

Two years from the crash, in most cases. For a death, two years from the date the person died. A city dump truck or county vehicle is different. You may need to send written notice within six months, or sooner under a city charter. See Civil Practice & Remedies Code §16.003.

Whose insurance pays for a truck crash?

Most often the carrier’s insurance company. An interstate hauler of ordinary freight has to carry at least $750,000. Tankers and hazmat loads need more. Your own PIP can cover early medical bills while the fight goes on. See 49 CFR §387.9.

Should I talk to the trucking company’s insurance adjuster?

Not without talking to us first. That adjuster works for the trucking company’s insurer. Anything you say on a recorded line can come back as “you were speeding” or “you said you felt fine.” Give your name and our number. Do call your own insurer, though; most policies say to report a crash promptly.

What if the trucking company says I caused the crash?

Then the truck’s own dashcam becomes the most important witness. Under Texas law (CPRC §33.001, §33.012), a jury that puts you over 50% at fault ends the claim. At 20%, you lose a fifth of the award.

Was the truck driver tested for drugs or alcohol?

After a crash that kills someone, the carrier must test the surviving driver. Testing is also required after an injury or tow-away crash when the driver gets a ticket. Alcohol tests are due within eight hours and drug tests within 32. See 49 CFR §382.303.

What if the trucking company loses the evidence?

Texas judges can tell the jury to presume the lost evidence would have hurt the company. Under Brookshire Bros. v. Aldridge, 438 S.W.3d 9 (Tex. 2014), that usually takes intentional destruction. A careless loss qualifies only if it leaves you no real way to prove your case. So we send a preservation letter in the first days.

How much could my truck accident case be worth?

Nobody can honestly quote a number on the first call. A broken pelvis and a stiff neck are very different cases. So are a clean ELD log and one full of gaps. We give you a range once we see the records.
