What to Do If You Have Back Pain After a Rear End Accident

Being wrongly accused of a car accident can feel overwhelming and disorienting, especially when you're expected to defend yourself against claims that simply aren't true. The emotional toll, combined with the threat of financial loss and legal complications, can leave you unsure of how to move forward. At The Law Firm of Aaron A. Herbert, P.C., we understand how deeply this can affect your life, and knowing what to do next can make all the difference when it comes to protecting your name and your rights.

Collect Evidence at the Scene

Strong evidence may play a critical role in your car accident case in Dallas. This includes anything that helps explain what happened and supports your version of events, such as:

  • Photographs of the Crash Scene: Take clear and thorough photos of the area, including the cars' positions, traffic signals, debris, and road markings. These details can help clarify how the crash unfolded.
  • Photographs of Vehicle Damage: Capture images of all damage to your car and the other vehicle. The location and extent of the damage may help show how the impact occurred.
  • Video Surveillance Footage: Check for nearby cameras that may have captured the collision. Request copies right away; many systems delete footage quickly.
  • Eyewitness Statements: Ask witnesses what they saw and get their contact information. Their perspective could support your claim.
  • Medical Records: Visit a doctor soon after the crash. Your medical file helps prove that your injuries were caused by the accident.
  • Police Report: Always call the police, even for minor accidents. Their report provides an official summary and may include initial fault findings.

Gathering these types of evidence early can help support your side of the story if you're wrongly accused of a car accident later on.

What Are the Best Steps to Take After a Car Accident?

Before the Police Arrive

  • Stay Calm: Losing control can cloud your thinking and lead to poor decisions.
  • Call the Police: Report the crash to the authorities, no matter what the other driver says.
  • Document Everything: As said by the Texas Department of Insurance (TDI), drivers should take pictures of the other cars involved, including license plates and damages, and also capture photos of street signs and road angles.
  • Seek Medical Attention: Even if you feel okay, get checked by a doctor to make sure no internal injuries were missed.

After the Accident

  • Notify Your Insurance Company: Let your insurer know about the accident and that you’re being falsely blamed.
  • Hire a Lawyer: A personal injury lawyer can help collect key evidence, manage insurance negotiations, and represent you if needed.

Gather Evidence:

  • Witnesses: Write down names and contact info for anyone who saw what happened and can support your side.
  • Photos/Videos: Secure any available footage or images that show how the accident took place.
  • Police Report: Request a copy of the official report, even if it lists you at fault.
  • Alibis: Save any details, records, or proof that confirm you were not responsible.
  • Maintain Records: Store copies of everything, medical paperwork, crash reports, and communication with your insurer.
  • Avoid Social Media: Don’t post anything about the crash online, even casually.
  • Consider Suing: If the other driver intentionally lied, you may be able to sue for defamation or misrepresentation.

Do Not Admit Fault

Admitting fault is one of the most common mistakes made by drivers involved in car accidents in Texas. It is common for a driver to quickly apologize to the other driver as soon as he or she gets out of the car. Admitting fault right away, however, can mean you end up absorbing 100 percent of the liability for a crash even if someone else also contributed.

Never admit fault while still at the scene of a car accident or while talking to an insurance company's representative. Admitting fault can halt an investigation before it begins, placing liability with you even if you did not actually cause the crash. If you believe you caused a car accident by pulling out in front of someone, for example, you may admit fault before an investigation can discover that the other driver was speeding and is also partially to blame.

Be Careful When Speaking to an Insurance Adjuster

A representative hired by the insurance company known as a claims adjuster will contact you shortly after your collision. Do not trust the claims adjuster, as he or she does not have your best interests in mind. The adjuster wants you to admit fault or make another mistake that can place liability for the car accident with you. Most attorneys recommend not talking to an insurance adjuster at all. If you do wish to talk to the adjuster, do not admit fault, agree to give a recorded statement, sign anything, or accept a settlement before you have spoken to a car accident attorney.

What Is Texas’ Comparative Fault Law?

The law may entitle you to compensation even if you are found to be partially at fault for a car accident. Texas is a comparative negligence state, meaning that a plaintiff can still recover a monetary award even if he or she contributed to the crash. A car accident lawyer can help you establish the other driver’s portion of fault to maximize your financial recovery as much as possible.

What Can Happen If I’m Falsely Accused?

Your insurance rates can increase, you could lose your claim, or even face legal consequences. These accusations carry real risks. It’s not just about who pays for damages; your reputation and finances are on the line.

A false claim may shift blame and liability to you. If you're not careful, this can result in denied coverage or a record of fault that follows you for years. Legal representation becomes especially valuable in these moments, not only to challenge the claim but to prevent long-term damage.

What Types of False Accident Claims Exist?

Not all false claims look the same. Some people exaggerate injuries, others fabricate details to avoid blame, and in some cases, there may be staged collisions. Each type can lead to unjust accusations against innocent drivers.

Here are common examples:

  • Fake injuries that didn’t occur during the crash.
  • Claiming a different version of events to assign blame.
  • Omitting key details that would shift responsibility.
  • Submitting altered or misleading photos.

In all these scenarios, documentation and witness statements are critical to clearing your name.

Can I Sue Someone For a False Claim?

Victims who are wrongly accused of a car accident often ask if legal action is possible, and the answer is yes. If someone knowingly makes a false statement that damages your reputation, you may have grounds for a lawsuit.

Under Texas Civil Practice and Remedies Code Sec. 73.001, defamation through written or visual form (known as libel) applies if the falsehood damages your reputation, causes financial harm, or exposes you to public ridicule. This includes any statement that impeaches your honesty, virtue, or integrity.

To succeed in such a case, you’ll need to show that the statement was false, made intentionally, and directly caused you harm. Legal action can help clear your name and recover financial losses from the false claim.

Hire a Dallas Car Accident Lawyer

It is important to hire an attorney if you have been wrongly accused of being at fault for a car accident in Dallas. A lawyer can immediately investigate your crash and preserve and collect evidence of fault on your behalf. A lawyer can also help you refute allegations of fault using experts and crash reconstructionists. Your Dallas car accident lawyer can take many steps to help you prove that someone else was to blame for the crash, making you eligible for financial compensation through that party's insurance company.
